STATEMENT OF MS. DONNA KULLA

BEFORE THE SENATE JUDICIARY COMMITTEE

SUBCOMMITTEE ON ADMINISTRATIVE OVERSIGHT AND THE COURTS

March 29, 2000

I was the Program Manager for the Advanced Sensors Applications Program (ASAP) from October 1990 through October 1999. I was then, and still am, an employee of the Intelligence Systems Support Office (ISSO). This office primarily supports OSD (Command, Control, Communications and Intelligence (C3I)).

In the fall of 1997, I participated in meetings with representatives of the Department of Justice, DoD General Counsel, and the Department of the Navy regarding Peter H. Lee, a TRW employee. These meetings concerned the Department of Justice's request for the relevant classification guide and for an evaluation of the appropriate classification of information reported to have been passed by Dr. Peter Lee to the PRC, as described in an affidavit prepared by Special Agent Cordova of the Federal Bureau of Investigation.

I reviewed the affidavit and publicly-available information on non-acoustic ocean imaging, including several articles by Dr. Lee. I also reviewed charts I received directly from Assistant U.S. Attorney Jonathan Shapiro, which he told me during the course of a telephone conversation Peter Lee had used during his lecture in the PRC. Subsequently, my office compiled and forwarded a literature review, including Peter Lee's articles and the charts noted above, as well as a classification guide, to the DOD General Counsel.

The above actions describe my total involvement in the Peter Lee case prior to being questioned in connection with the investigation of the Senate Judiciary Subcommittee on Administrative Oversight and the Courts, starting last fall.
